a firm which:

1. (1) contributes input data to a BMR benchmark administrator;
1. (2) is located outside the United Kingdom; and
1. (3) either
   1. (a) is a supervised entity; or
   1. (b) would be a supervised entity if it were located in the United Kingdom.
