EEA right

    (in accordance with paragraph 7 of Schedule 3 to the Act (EEA Passport Rights)) the entitlement of a person to establish a branch or provide services in an EEA State other than that in which he has his relevant office:

      1. (a) in accordance with the Treaty as applied in the European Economic Area; and
      1. (b) subject to the conditions of the relevant Single Market Directive or the auction regulation.

    in this definition, relevant office means:

      1. (i) in relation to a person who has a registered office and whose entitlement is subject to the conditions of the IDD, his registered office; and
      1. (ii) in relation to any other person, his head office.
